Since the 1970s Ireland has been the hub of the international aircraft finance and leasing industry. Today 14 of the top 15 aircraft leasing companies are based in Ireland. This module gives students a comprehensive introduction to the sector and prepares them for opportunities in the sector.
The module covers the primary legal and practical aspects of international aviation finance and leasing law, covering aircraft, aircraft engines and helicopters. The principle objective of international aviation finance law is to facilitate the efficient purchase, finance and lease of aircraft objects.
The module introduces the student to the core aspects of aircraft leasing, examining the most important contract terms. As a core element of the module we also examine the process of purchasing new aircraft, and trading used aircraft and the specific issues arising therefrom.
We will consider sources of finance, and taking security over aircraft objects in an international context generally but with an emphasis on security in an Irish context, as well studying the typical structures utilised in aviation finance and leasing transactions. We consider what happens when something goes wrong – when there is an event of default – and the remedies open to a creditor including considerations when seeking to repossess an aircraft.
The module examines tax considerations in aviation finance and leasing transactions from an Irish and international perspective. We also consider aviation insurance and jurisdictional issues arising by virtue of the cross border context of the sector, and international treaties in the sector, with particular emphasis on the Cape Town Convention and the Aircraft Protocol, and the International Registry of Mobile Assets, managed by Aviareto Limited in Dublin.



This course will be taught only if a sufficient number of students enrol. Any aspect of this module may be changed in any given academic year, subject to the discretion of the module lecturer.
